Parties: The Islamic Republic of Iran Judo Federation (the „Appellant“ or the „IRIJF„) is the governing body of judo in the Islamic Republic of lran („IRI“), which in turn is affiliated to the International Judo Federation.
The International Judo Federation (the „Respondent“ or the „IJF„) is the governing body of judo worldwide.
Merits of the case: Did the Appellant instruct the Athlete not to compete or to deliberately lose contests at the Tokyo World Championships Senior?
Paragraph 94:
In light of the above considerations, the Panel holds that it is established that the Appellant instructed the Athlete to deliberately lose his contests at the 2019 Tokyo Judo World Championships in order to avoid competing against an Israeli athlete at a later stage.
Did the Appellant breach the principle of political neutrality and non discrimination under the IJF Statutes and Other Related Rules?
Paragraph 103:
In light of the above-mentioned provisions, the Panel confirms that, as evidenced under the Olympic Charter, the principle of political neutrality and the principle of nondiscrimination represent Fundamental Principles of Olympism as well as one of the objectives of the IOC. As a member of the Olympic Movement, the IJF commits to promote the ideals and objectives of the IOC and to consider the adherence to such fundamental principles in particular the principle of political neutrality and the principle of non-discrimination as essential. As a result, the IJF imposes upon its Member National Federations – as a precondition to be a Member – to confirm that they adhere to those principles by imposing that they comply with the IJF Statutes and that their statutes are themselves in compliance with the IJF Statutes and the Fundamental Principles of the Olympism, as detailed in the Olympic Charter. The Panel therefore holds that the Appellant is undoubtedly bound by the principle of political neutrality as well as the principle of non-discrimination as provided for under the Fundamental Principles of Olympism in the Olympic Charter and the IJF Statutes.
Paragraph 107:
The Panel therefore concludes that by instructing the Athlete to deliberately lose his contests at the 2019 Judo World Championship Senior, the Appellant breached the principles of political neutrality and non-discrimination as provided under the IJF Statutes and the Olympic Charter.
Whether the IJF violated the principle of fairness as provided under the IJF Statutes and other rules of the IJF Code of Ethics.
Paragraph 111:
“the Appellant’s claim with respect to the behaviour of the IJF officials in the present matter is not supported by any evidence; in the Panel’s view, the behaviour of the IJF officials reflects respect of the principle of political neutrality rather than unfairness.”
Does the sanction imposed in the Suspension Decision have the necessary legal basis and proportionality?
Paragraph 124:
Indeed, Article 12 of the IJF Disciplinary Code provides for a list of applicable sanctions, as follows:
„The disciplinary sanctions should be chosen from the measures below:
1) Sports penalties such as downgrade, disqualification, withdrawal of a medal or title.
2) Disciplinary sanctions chosen from the following measures:
a) Warning
b) Reprimand
c) Suspension from a competition or duties
d) Fines, though they cannot exceed the fines set for the contraventions under Swiss law.
e) Provisional or definitive withdrawal of the status of the IJF member and all its affiliated components.
f) Expulsion
3) Ineligibility to the governing bodies for a specified period
Paragraph 125
In the Panel’s view, in accordance with the principle nulla poena sine lege, the IJF Disciplinary Commission is bound by this exhaustive list of possible sanctions. While the IJF Disciplinary Commission enjoys a certain discretion in order to adjust the sanction to the specificities of a particular case, for instance by choosing the appropriate sanction among the list of possible sanctions or to qualify the alleged violation as a „serious breach“ or a „gross negligence“ or to adjust the sanction where the rules leaves sufficient room for such adjustment, the principle of nulla poena sine lege prevents the IJF Disciplinary Committee to impose a sanction that is not provided for in the list of possible sanctions or to impose to a specified sanction different modalities than those expressly provided for in the text.
Paragraph 128
In light of the above considerations, the Panel holds that the Suspension Decision lacks the necessary legal basis. As a result, the Panel finds that the Suspension Decision must be annulled. Based on Article R57 of the CAS Code, the Panel holds that the case shall be referred back to the IJF Disciplinary Commission, for its appropriate sanction(s), taking into account all relevant circumstances – inter alia – the suspension already imposed on the Appellant.
Does the sanction imposed in the Suspension Decision constitute an illegal violation of the Appellant’s personality rights?
Paragraph 133
In the present matter, as was confirmed in the present award, in the view of the Panel, the Appellant committed a serious breach of the IJF Principles, for which a sanction must be imposed. Also, the seriousness of the present matter is beyond doubt, as the rules that were infringed by the Appellant constitute Fundamental Principles of Olympism. Finally, the Panel notes that the Appellant is not prevented from any judo activity: it can still organise competitions and other events at the national and local level and develop judo within the IRI. As a result, the Panel finds that there is no violation of the Appellant’s personality rights.
The Appellant’s claim for compensation for the damage suffered as a result of the Appealed Decisions
Paragraph 138
In the present matter, the Panel has already concluded that the Appellant committed a serious breach of the IJF Principles and Fundamental Principles of Olympism. As a result, the IJF Executive Commission was entitled to initiate disciplinary proceedings before the IJF Disciplinary Commission. It follows form such conclusion that the IJF Disciplinary Commission was entitled to adopt provisional measures for the duration of the disciplinary procedure. The Panel therefore finds that the Provisional Suspension Decision is legally valid and therefore does not constitute a wrongful act. As a result, the Panel finds that the Appellant’s claim for compensation as to the Provisional Suspension Decision shall be dismissed.
COSTS
Paragraph 141
Furthermore, pursuant to article R65 .3 of the CAS Code, having taken into account the outcome of the arbitration, the conduct of the Parties in the arbitration, and the respective financial resources, the Panel decides that the Appellant shall pay a contribution in the amount of CHF 5’000 towards the Respondent’s legal fees and other expenses incurred in connection with the present proceedings.

PARIS GRAND SLAM 2021 DIESES HERBST
In Reaktion auf die Pressemitteilung, die gestern, am 2. März 2021 von der französischen Judo-Föderation veröffentlicht wurde, stellt die Internationale Judo-Föderation die folgenden Klarstellungen zum Grand Slam 2021 in Paris.
Die International Judo Federation hat den Grand Slam 2021 in Paris nie abgesagt. Es wurde nie ein Event-Hosting-Vertrag unterzeichnet . Da der IJF-Kalender vor den Olympischen Spielen voll ist, bietet der IJF dem französischen Judo-Verband die Möglichkeit, diese Veranstaltung im Herbst 2021 abzuhalten, obwohl der Event-Hosting-Vertrag bisher nicht unterzeichnet wurde. Darüber hinaus berief sich die IJF auf die Notwendigkeit der Klärung und des Abschlusses des Abkommens und schlug dem neuen Präsidenten der französischen Judo-Föderation, Herrn Stéphane Nomis, seit seinem Amtsantritt mehrfach vor, den Grand Slam von Paris als oberste Priorität zu betrachten .
Obwohl die IJF im Mai einen Platzhalter in den Kalender für die Pariser Veranstaltung aufgenommen hatte, erhielt sie weder ein angemessenes Feedback zu irgendwelchen Aspekten der in Paris zu organisierenden Veranstaltung noch eine unterzeichnete Vereinbarung, um die olympischen Qualifikationsmöglichkeiten für das Judo sicherzustellen Athleten auf der ganzen Welt, die IJF war verpflichtet, den Kalender für Mai fertigzustellen. Wir sind der Russischen Judo-Föderation und der Stadt Kasan sehr dankbar, die sofort positive Rückmeldungen gaben und eine Vereinbarung über die Ausrichtung des Kasaner Grand Slam vom 5. bis 7. Mai 2021 unterzeichnet haben.
Die International Judo Federation drückt ihre Wertschätzung und ihren Respekt für den Beitrag der französischen Judo Federation und der französischen Athleten zur internationalen Judo-Bewegung im Laufe der Zeit sowie für die beeindruckende Geschichte dieses besonderen Turniers aus, das immer im Februar stattgefunden hat. Angesichts der geschaffenen Situation und der allgemeinen globalen Gesundheitskrise ist die IJF bereit, die üblichen Daten des Grand Slam von Paris für die Jahre 2022, 2023 und 2024 zu garantieren, während wir der französischen Judo-Föderation für 2021 die Möglichkeit bieten, eine auszuwählen passendes Datum im Herbst.
Wir hoffen, dass die französische Judo-Föderation diesen Herbst einen Grand Slam organisieren kann, insbesondere unter Berücksichtigung der reichen Geschichte dieses Ereignisses, das die Judo-Familie jedes Jahr in Bercy in einer besonderen Atmosphäre vereint. Wir sind sicher, dass diese Veranstaltung einen großen Erfolg haben wird, da sowohl französische als auch internationale Athleten und ihre Ergebnisse bei den Olympischen Spielen in Tokio sportlich gefeiert werden und die Reise nach Paris 2024 beginnen wird.

GESUNDHEIT ZUERST
Angesichts der anhaltenden Unsicherheit in Bezug auf die Covid-19-Pandemie und der Tatsache, dass Japan das Austragungsland der Olympischen Spiele ist, muss die IJF bei der Planung von Veranstaltungen in Japan besonders vorsichtig sein. Aus diesem Grund wurde beschlossen, den Tokyo Grand Slam abzusagen, der zuvor im Dezember in Japan stattfinden sollte.
Da es bereits mehrere IJF-Veranstaltungen sowie viele nationale Wettbewerbe gibt, die ab Anfang 2021 stattfinden werden, wurde vereinbart, diesen Grand Slam abzusagen und nicht zu verschieben. Im gleichen Zeitraum plant die Internationale Judo-Föderation jedoch, gemeinsam mit der Kroatischen Judo-Föderation den Großen Preis von Zagreb zu organisieren.
Es wurde auch beschlossen, die Organisation der anderen Veranstaltungen, einschließlich des Budapester Grand Slam, Ende Oktober fortzusetzen. Die IJF wird den Grand Slam von Budapest Anfang Oktober bestätigen, bis eine Entscheidung der ungarischen Regierung vorliegt.
Wir freuen uns auch, Ihnen mitteilen zu können, dass Katar positiv bestätigt hat, dass die World Judo Masters vom 11. bis 13. Januar stattfinden werden.

Dear Judokas,
Dear Judo Family Members,
We find ourselves in a strange and sad period. Due to the large scale of the Covid-19 outbreak, we are now facing a period of uncertainty and an unprecedented challenge.
I would like to send out a strong message of support to all those affected by this situation, it is important to stay healthy and united. My thoughts are with those from the worst-hit countries, where the virus claimed many lives and the entire society lives in isolation.
As you know, the International Judo Federation has cancelled all events until April 30, in an attempt to protect the interests of all stakeholders, keep the judo community safe and ensure fair treatment to all athletes engaged in the Olympic qualification. We continue to work hard in order to find the best solutions and we hope that we can continue our activities as planned once the critical period is over.
In such challenging times, we need to be resilient and protect each other, and I encourage all of you to apply all the principles of our sport, setting an example for those around you.
I wish all of you, as well as the people of the world, good health and a strong spirit!

Nous nous retrouvons dans une période étrange et triste. En raison de l’ampleur de l’épidémie de Covid-19, nous sommes désormais confrontés à une période d’incertitude et à un défi sans précédent.
Je voudrais envoyer un message fort de soutien à toutes celles et ceux qui sont touchés par cette situation. Il est important de rester en bonne santé et unis. Mes pensées vont aux habitants des pays les plus touchés, où le virus a coûté la vie à de nombreuses personnes et où toute la société vit isolée.
Comme vous le savez, la Fédération internationale de judo a annulé tous les événements jusqu’au 30 avril, dans le but de protéger les intérêts de toutes les parties prenantes, d’assurer la sécurité de la communauté du judo et d’assurer un traitement équitable à tous les athlètes engagés dans la qualification olympique. Nous continuons à travailler avec acharnement pour trouver les meilleures solutions et nous espérons pouvoir poursuivre nos activités comme prévu une fois la période critique terminée.
En ces temps difficiles, nous devons être résiliants et nous protéger les uns les autres. Je vous encourage à appliquer tous les principes de notre sport, en donnant l’exemple à ceux qui vous entourent.

Nos encontramos en un momento extraño y triste. Debido a la magnitud de la epidemia Covid-19, ahora nos enfrentamos a un periodo de incertidumbre y desafío sin precedentes.
Quiero enviar un mensaje de apoyo a todos los afectados por esta situación. Es importante mantenerse sanos y unidos. Mis pensamientos están con la gente de los países más afectados, donde el virus se ha cobrado la vida de muchas personas y donde toda la sociedad vive en aislamiento.
Como saben, la Federación Internacional de Judo ha cancelado todos los torneos hasta el 30 de abril, con el objetivo de proteger los intereses de todas las partes interesadas, garantizar la seguridad de la comunidad del judo y el trato justo para todos los atletas que optan para la clasificación olímpica.
Continuamos trabajando arduamente para encontrar las mejores soluciones y esperamos poder continuar nuestras actividades según lo planeado una vez que finalice el periodo crítico.

Уважаемые члены Семьи дзюдо!
Мы сейчас переживаем странное и грустное время. Из-за масштабных вспышек коронавируса, мы все столкнулись с неясностью и беспрецедентным вызовом.
Я бы хотел направить теплые слова поддержки всем, кого коснулась данная ситуация, – сейчас важно оставаться здоровыми и сплоченными. Мысленно я со всеми жителями наиболее пострадавших стран, где вирус унес много жизней, а все общество живет в изоляции.
Как вы знаете, Международная Федерация дзюдо отменила все соревнования до 30 апреля, пытаясь защитить интересы всех заинтересованных сторон, обеспечить безопасность сообщества дзюдо и гарантировать справедливое отношение ко всем спортсменам, участвующим в олимпийской квалификации. Мы продолжаем усердно работать, чтобы найти лучшие решения, и мы надеемся, что сможем продолжить наши запланированные мероприятия после того, как критический период закончится.
